These Terms of Use ("Terms") govern the access to and use of the website www.bestlogo.in ("Website") and the purchase and use of any logo design, brand identity, graphic design or related services ("Services") offered through the Website.
BestLogo.in is an initiative operated and managed by Trimitiy Studios Pvt. Ltd., a company incorporated under the applicable laws of India, hereinafter referred to as "BestLogo.in", "Company", "we", "us" or "our".
Any person accessing the Website, submitting a creative brief, communicating with the Company, making payment or purchasing any Service shall hereinafter be referred to as "Client", "Customer", "User", "you" or "your".
By accessing the Website, submitting an order or making payment, you acknowledge that you have read, understood and unconditionally agreed to these Terms together with our Privacy Policy, Cookie Policy, Refund Policy, Cancellation Policy, Invoicing Policy, Timeline Policy, Communication Policy and any package-specific conditions displayed on the Website.
You represent that you are legally competent to enter into a binding contract under applicable Indian law.
Where an order is placed on behalf of a company, partnership, LLP, proprietorship, organisation or other entity, the person placing such order represents and warrants that such person has sufficient authority to bind the concerned entity.
BestLogo.in provides professional logo design and related brand-design services based upon the package selected by the Client.
The number of concepts, revisions, file formats, additional brand elements and other deliverables shall be limited strictly to those specifically mentioned in the selected package at the time of purchase.
The Client acknowledges that design is inherently subjective. A difference in personal preference, taste, opinion or expectation shall not, by itself, constitute deficiency in Service.
The quality, relevance and accuracy of the design output depends substantially upon the information supplied by the Client.
The Client shall provide complete and accurate information concerning, including but not limited to:
BestLogo.in shall not be responsible for delay, rework, incorrect output or additional cost arising from incomplete, incorrect, misleading or subsequently changed information supplied by the Client.
Each Service is sold on a defined-package basis.
Only the deliverables specifically mentioned in the purchased package are included.
Any work outside such scope, including additional concepts, additional revision rounds, redesign after approval, change in business/brand name, additional stationery, packaging, social media creatives, brand manuals, trademark work, printing or any other work not expressly included shall constitute additional work and may be separately chargeable.
"Logo Concept" means a distinct creative design direction presented for Client evaluation.
A request to modify an existing concept shall constitute a revision.
A request for an entirely new creative direction after the allocated concepts have been exhausted may be treated as an additional concept and charged separately.
The number of revision rounds shall be strictly limited to the number mentioned in the selected package.
Unless otherwise expressly agreed, revisions are intended for refinement of the selected concept and not for creating unlimited alternative concepts.
A consolidated set of modifications communicated by the Client at one time shall ordinarily constitute one revision round.
Repeated, contradictory or fragmented modification instructions may be treated as separate revision rounds.
Once design work has commenced, any substantial alteration to the original brief including change of:

The Company reserves the right to quote separately for such additional work.
The entire amount payable for the selected package shall ordinarily be payable in advance, unless expressly agreed otherwise in writing.
An order shall be considered confirmed only upon successful receipt of payment and the required project brief/details.
Published prices and confirmed package charges shall be inclusive of applicable GST, unless an exceptional quotation expressly states otherwise.
Payments may be processed through third-party payment gateway providers. The Website currently identifies Razorpay as its payment processing facility.
Subject to rights that cannot lawfully be excluded, all payments made towards a confirmed design order are final and non-refundable.
The Company reserves creative resources, professional time, personnel and production capacity immediately following confirmation of an order.
The Refund Policy displayed on the Website shall form an integral part of these Terms.
Once payment has been made and an order has been confirmed, the order cannot ordinarily be cancelled by the Client.
Non-response, change of mind, closure of business, change of business name, selection of another designer or abandonment of the project shall not entitle the Client to cancellation or refund.
Nothing contained herein shall restrict any remedy mandatorily available under applicable law.
The turnaround/delivery period mentioned in any package is dependent upon timely:
Any delay by the Client shall automatically extend the corresponding project timeline.
BestLogo.in shall not be responsible for delays caused by the Client or circumstances beyond its reasonable control.
The Client is solely responsible for carefully verifying all content before granting approval, including:
Once a design has been finally approved, subsequent corrections or alterations may be chargeable.
The principal mode of project communication may be a WhatsApp group or other communication channel designated by BestLogo.in, depending upon the package purchased.
Messages, instructions, selections and approvals communicated by the Client or its authorised representative through the designated communication channel shall be treated as valid project instructions.
The Client is responsible for ensuring that only authorized persons with one single point of contact participate in the designated communication channel.
Subject to full payment of all amounts due and final approval of the selected logo, rights in the final approved original logo artwork created specifically for the Client shall be transferred to the Client to the extent stated in the applicable package.
The Website currently specifies "Final Logo Ownership After Approval" within its packages.
Unless otherwise agreed in writing:

Third-party fonts, software, typefaces, stock assets or licensed materials, where legally used, shall remain subject to the license terms of their respective owners.
Logo design services do not include trademark search, trademark availability verification, trademark registration, legal opinion or intellectual-property clearance unless specifically purchased as a separate service.
A logo being designed or delivered by BestLogo.in shall not constitute a representation or warranty that:
The Client is strongly advised to conduct appropriate trademark searches and obtain professional legal advice before commercial adoption or registration.
The Client represents and warrants that it owns, has licensed or is otherwise legally entitled to provide and authorize use of all:

The Client shall be responsible for claims arising from unauthorised material supplied by the Client.
Unless confidentiality has been specifically agreed in writing before commencement of work, the Company may display the final publicly launched design for bona fide portfolio, award-entry, credentials, case-study, website or social-media purposes.
Such display shall not transfer Client ownership back to the Company.
No User shall use the Website or Services:

To the maximum extent permissible under applicable law, BestLogo.in shall not be liable for indirect, consequential, incidental, special or business losses including loss of profits, anticipated business, goodwill, reputation or opportunity resulting from the use of the Services.
The aggregate contractual liability of BestLogo.in relating to a particular paid assignment shall, to the extent legally permissible, not exceed the amount actually paid by the Client to BestLogo.in for that particular assignment.

The Client agrees to indemnify and hold harmless Trimitiy Studios Pvt. Ltd., BestLogo.in and their directors, employees, consultants and authorised representatives against losses, liabilities, claims and reasonable expenses arising out of:
The Website may integrate payment gateways, hosting services, analytics services, WhatsApp or other third-party platforms.
Such services may be governed by separate terms and privacy practices of the respective third parties.
BestLogo.in shall not be responsible for an independent third-party platform's downtime, security failure or operational interruption except to the extent liability arises directly from BestLogo.in under applicable law.
BestLogo.in shall not be liable for delay or failure caused by events beyond its reasonable control including natural disasters, government action, strikes, internet outages, power failures, cyber incidents, epidemics, war, civil disturbance or failure of third-party infrastructure.
BestLogo.in may modify these Terms periodically to reflect changes in law, business practices or Services.
The Terms applicable to an already confirmed order shall ordinarily be those prevailing on the date of confirmation, except where modification is required by law.
These Terms shall be governed by and interpreted in accordance with the laws of India.
Subject to any jurisdiction conferred upon consumer commissions, statutory authorities or other forums under mandatory applicable law, the courts of competent jurisdiction at Pune, Maharashtra, India shall have jurisdiction over disputes arising out of these Terms or the Services.
